Description
Public utility easements (SUPs) are administrative limitations to the right to property. They are established for the benefit of public persons, concessionaires for public services or public works, private persons engaged in an activity in the general interest.
Easements Type: passage to the right of chemical transport pipelines.
Passive obligations
Obligation for owners to allow the free passage of surveillance and maintenance officers, as well as screening officers.
Obligation on the owners or their successors in title to refrain from any act likely to impair the construction, proper operation and maintenance of the work.
Prohibition for owners to build sustainable construction on the 5-metre band.
Prohibition on owners to carry out in the 5-metre band cultural ways exceeding 0.60 metres deep or less depth if there is administrative derogation and any tree or shrub plantations.
Residual rights of the owner:
Possibility for owners to proceed in the 5-metre band in cultural ways less than 0.60 metres deep, unless otherwise permitted.
Possibility for owners to request the acquisition by the carrier, within one year of the parcel investigation:
Of all or part of the broadband
Remains of bare land crossed by the work, when as a result of
the existence of servitude, they are reduced to a quarter of the total capacity, if
however, on the one hand, the owner has no land immediately contiguous, if, on the other hand, these remains have an area of less than 10 ares or are fully included in a 10-metre band adjacent to the broadband.
Land, regardless of its area, for which the permit to
construction is refused because of the existence of servitude.
In the absence of an amicable agreement, the most diligent party may refer the matter to the expropriation judge.
The right of the owner to request the acquisition of the land at any time, if the existence of the easements renders it impossible for the normal use of the said land.
Right of the owner to require the beneficiary to restore the cropland to their condition by restoring the arable layer and road.
