Only a few dungeons, cellars and towers are still used to detain defendants awaiting sentencing. The Criminal Code of 1791 establishes deprivation of personal liberty as a punishment for citizens who have misused it. In 1797, the French garrison gathered in Neumünster Abbey, deserted by the Benedictine monks, those sentenced to imprisonment, except those charged with crimes punishable by death. The latter are locked in the dungeons of the Three Towers of the Pfaffenthal. In 1809, the prison moved to a new building on Rue Saint-Ulric in Luxembourg. The women moved in 1841 to a building in Henkeschgaass (now Biisserwee) and then in 1853 to Hospice Saint-Jean following a Grand-Ducal Royal Decree of 18 April 1851 entrusting the management of the prisoners to the Franciscan Sisters. Following the opinion of 18 December 1867 of the special committee headed by the Director-General of Justice, H. Vannérus, the disused Neumünster Abbey was temporarily converted into a prison. This temporary situation lasted until the opening of Schrassig prison on 15 May 1884. In parallel with the development of a modern central prison, an alternative institution for the enforcement of custodial sentences appears: the Givenich semi-open penitentiary centre. Indeed, in 1893, former Member of Parliament and landowner Mathias Theisen donated to the State of plots of land and buildings to establish an agricultural colony for orphans, indigent children, young delinquents and old people. In the 1930s, the first inmates of the Neumünster prison went to Givenich to carry out agricultural work. In 1956, the Givenich site became a semi-open prison with the construction by the State of a residential building comprising 27 individual cells. In order to comply with international standards on the separation of detainees and accused persons, the Luxembourg authorities launched in 2016 the construction of a second closed prison on the municipal territory of Sanem. The Prison Service was set up in 2018 under the supervision of the Ministry of Justice.
