Description
DESCRIPTION: The legal declaration called Asset of Cultural Interest is a protection figure regulated by Law 16/1985, of June 25, on Spanish Historical Heritage. Subsequently, this figure of the highest rank has been gradually assumed by the legislation of the autonomous communities, entities that participate in the initiation of files and studies, with the supervision of the Ministry of Culture for the final declaration. According to the Law itself, a BIC is any property and movable object of artistic, historical, paleontological, archaeological, ethnographic, scientific or technical interest, which has been declared as such by the competent administration. It can also be declared as BIC, documentary and bibliographic heritage, archaeological sites and zones, as well as natural sites, gardens and parks, which have artistic, historical or anthropological value. METHODOLOGY: In accordance with the provisions of Law 16/1985, for an asset to become part of the Catalogue of Assets of Cultural Interest of Spain, a file must be initiated by the competent administration (although it can be done at the request of entities or individuals). Once the file has been opened, all the legal protection provided for in the laws applies to the property, as a preventive measure. The file is resolved by agreement, either of the Governing Council of the Autonomous Community, by Decree (when this competence is transferred), or of the Council of Ministers on a proposal from the Ministry of Culture, by Royal Decree.
