Description

Environmental sensitivity to the installation of wind farms and associated auxiliary infrastructures in mountains of public utility (MUP) and protective mountains of Castilla y León. Both Law 43/2003, of 21 November, of Montes, national, and the autonomous Law 3/2009, of 6 April, on mountains of Castile and Leon establish a regime of protection for the mountains of public utility and mountains declared protective. Under this scheme, only those activities compatible with the reasons which promoted the declaration as such and, in any case, compatible with the persistence of the natural values of the mountain are permissible. In this sense, the installation of wind farms in unforested areas of these mountains, which do not maintain other values (e.g. the existence of certain habitats or the location of species of interest) and which, in any case, must be evaluated on a case-by-case basis, may be compatible with their demaniality in the case of UP mountains or their declaration as a protective forest. It should be noted that, as established in Article 16 of Law 3/2009, of 6 April, on mountains of Castile and Leon, projects for the construction of all types of infrastructures outside forest management will avoid, provided that there are viable alternatives, affecting listed mountains of public utility and protective forests. * The submission of this information does not replace the relevant environmental impact assessment procedures for projects or prejudge the results of the corresponding environmental impact statements, since they are offered only to facilitate an early assessment from the early stages of defining a potential renewable energy project on the condition to a specific space with high environmental sensitivity.
