Resolution of denationalisation cases in district courts — situation as at 31. 12. 2021

in the case of the resolution of denationalisation cases before the district courts — Article 5 ZDen, I send you two tables and the reasons for the 37th monitoring of statistics at district courts.
The tables submitted show that 42 district courts (Ajdovščina, Brežice, Celje, Cerknica, Črnomelj, Domžale, Gornja Radgona, Grosuplje, Idrija, Ilirska Bistrica, Jesenice, Kamnik, Koper, Kočevje, Kranj, Krško Lenart, Lendava, Litija, Ljutomer, Maribor, Murska Sobota, Nova Gorica, Novo mesto, Ormož, Piran, Postojna, Ptuj, Sežana, Sevnica, Slovenska Bistrica, Slovenj Gradec, Slovenj Gradec, Slovenske Konjice, Šentjur, Škofja Loka, Šmarje pri Jelšah, Tolmin, Trbovlje, Trebnje, Velenje Vrhnika and Žalec) have already completed the final resolution of claims under Article 5 ZDen.
The proportion of cases finally closed in courts is 99.9 % in relation to all denationalisation cases (minus assigned submissions).
According to the information provided to us by the courts, they had the status as at 31. 12. 2021, a total of 4 cases are still pending. The number of pending cases has decreased by 1 since the previous follow-up.
In the last report, the Maribor District Court informed that among the cases received (so far 261) it also considered a case under the Criminal Enforcement Act rather than the Denationalisation Act, which reduced the total number of cases brought by 1 (to 260). Furthermore, the Maribor District Court also re-examined the number of cases finally closed, since it has so far reported that out of 260 decisions issued, it has “only” 224 final, and found that all 260 decisions issued are already final. As a result, the total number of cases finally resolved by all courts also increased from 2641 to 2678 and the percentage of resolved cases from 99.6 % to 99.9 %.
Thus, the Maribor District Court finally concluded the denationalisation procedures under Article 5 of the Denationalisation Act. Of the 44 district courts, only 2 courts have open denationalisation procedures (Ljubljana 4 cases and Radovljica 1 case).
