Art. 16 - Establishment of the municipal register of free forms of association
The Municipality of MATERA, in implementation of Legislative Decree 18.08.2000, No. 267, and the Municipal Statute, in order to enhance and promote free forms of association, establishes the Municipal Register of Associations, hereinafter referred to as the Register, which has the function of registering the associative bodies operating in the municipal territory, which expressly request to be registered.
The register of free forms of association also responds to the idea of Regional Law No 40/2009 on the promotion and regulation of associations with socio-cultural aims.
The Register shall be kept by the Culture Office, which shall manage and update it in the manner provided for in this Title. The same Register may be consulted in accordance with the rules on the right of access to administrative documents.
The Register is divided into the following thematic sections:
a. Health and social activities;
b. Civil commitment;
c. Protection and promotion of human rights;
d. cultural and educational activities;
e. Musical, recreational and sporting activities;
f. Environmental protection;
g. Activities of an international nature;
Each free associative form can subscribe to only one thematic section.
Article 17 - Requirements for registration
Free forms of association that meet the following requirements can register in the Register:
They are non-profit-making and pursue purposes of collective interest;
They are legally constituted in accordance with the relevant rules in force, i.e. by authentic instrument or by authenticated or registered private document; non-profit organisations must be established and operate in accordance with Article 10 et seq.
Legislative Decree No 460/1997;
They are established on the date of application for registration;
have their operational headquarters in the Municipality of Matera even if the registered office is established in another
Municipality, carry out activities in the municipal territory;
democratic association structure;
have at least 10 members
The following may not be entered in the Register:
- trade unions;
- parties;
- the forms of association and organisation directly emanating from the municipal administration, or
of other public bodies or administrations.
