Description
The eligibility procedure is activated in order to assess whether a project is likely to have a significant and negative impact on the environment and whether it should therefore be subject to the EIA procedure.
The verification procedure applies to three cases, illustrated below and described below:
in the case of new projects for works, installations or interventions, the size of which exceeds that laid down in Annex IV to Part II of Legislative Decree No 152/2006; for projects for the modification or extension of works, installations or interventions with size thresholds below those indicated in Annex IV to Part II of Legislative Decree No 152/2006 in compliance with the criteria defined by Ministerial Decree No 52/2015; in the case of projects for the substantial modification or extension of works, installations or interventions already authorised or carried out or in the process of being carried out, irrespective of the size thresholds laid down in Annex III and IV to Part II of Legislative Decree No 152/2006, the significance of the impact has been ascertained by the Service.
Where the works fall, even partially, within sensitive geographical areas, the size thresholds laid down in Annex IV shall be reduced by 50%.
The procedure is of public importance and anyone can view the documentation and submit their written observations. The verification procedure concludes with the adoption of a determination by the Director of the Environmental Authorisations and Assessments Service that determines whether or not the EIA procedure is applicable.
The verification procedure is mandatory, in the cases provided for by the standard, except that the proposer, independently noting that the project presents significant interference with the environmental components, does not directly activate the EIA procedure.
