Sites subject to remediation procedures
Description
The Provincial Environmental Protection Agency manages the register of sites subject to the remediation procedure referred to in Article 251 of Legislative Decree No 152/06, as also provided for in Article 77bis(10ter) of the TULP (Presidential Decree No 1-41/Leg of 26 January 1988). Other types of sites have also been included in the register and should be tracked for planning and land use purposes. For any information, please refer to the Provincial Agency for Environmental Protection – Authorisation and Control Sector – Waste and Remediation Unit for polluted sites. The ‘SITES SUBJECT TO TRANSFER PROCEDURE’ are divided, according to the legislation in force, into the following classes: - Potentially contaminated sites: include all notified situations of potential contamination (pursuant to Articles 242, 244 or 245 of Legislative Decree No 152/06). The classification of a potentially contaminated site remains so until a risk analysis is approved that determines its classification as a ‘contaminated site’ or ‘non-contaminated site’, or until the completion of the remediation measures if the site is managed under a simplified procedure (pursuant to Article 242a or 249 of Legislative Decree No 152/06). - Contaminated sites: they represent sites that have been found to be contaminated downstream of a specific site risk analysis (contamination with concentrations above the risk threshold concentrations) or that are polluted within the meaning of Ministerial Decree No 471/99 (registered in the register before the entry into force of Legislative Decree No 152/06). - Reclaimed sites: represent the sites reclaimed (in ordinary or simplified procedure) and the sites with permanent safety and closed procedure. - Uncontaminated sites: sites exceeding the contamination threshold concentrations (CSCs referred to in Annex 5 to Part IV of Legislative Decree No 152/06) but not exceeding the risk threshold concentrations (CSRs) calculated using site-specific risk analysis. In the latter case, any constraints on the use of the euro area may be envisaged.
IMPORTANT: in order to confirm the exact extent of the sites covered by the remediation procedure and the relative status of the remediation procedure, reference must be made to the municipality with territorial jurisdiction or to the APPA Authorisation and Control Sector.
