Description

Created by the Sapin II law of 9 December 2016, the obligation to establish traceability and the collection of alerts aims to protect whistleblowers in good faith and to improve transparency and the fight against corruption. This compendium applies to public officials, employees and occasional and external employees of the public service who, on the occasion of their assistance, could reveal or report crimes or offences constituting an infringement of probity. The whistleblower must have witnessed or had personal knowledge of the facts constituting the alert. The alert must be based on objective data:specific facts, documents, testimonies, etc. The report must be made in good faith and in a disinterested manner. In the event of serious bad faith and intent to harm, the abusive whistleblower is exposed to disciplinary sanctions and to legal proceedings where appropriate. Conversely, the use of the device in good faith, even if the facts subsequently prove inaccurate or give rise to no follow-up, does not expose the author of the alert to any disciplinary sanction.
