CyL renewables: MUP Environmental Sensitivity

Description

Environmental sensitivity to the installation of wind farms and photovoltaic plants in mountains of public utility (MUP) of Castilla y León. Both Law 43/2003, of 21 November, on Forests, national, and the regional Law 3/2009, of 6 April, on Forests of Castilla y León establish a protection regime for forests of public utility. Under this regime, only activities compatible with the reasons that promoted the declaration of public utility of these mountains and, in any case, compatible with the persistence of the natural values of the mountain are authorized. In this sense, there is a different position regarding the two types of installations: while the massive occupation of the territory by photovoltaic plants makes it difficult to reconcile their installation with the persistence of the values that led to the declaration of public utility of the mountain, the installation of wind farms in deforested areas of the UP mountains, which do not maintain other values (for example the existence of certain habitats or location of species of interest) and which, in any case, should be evaluated on a case-by-case basis, may be compatible with the demaniality of the mountain. * The presentation of this information does not replace the relevant procedures for environmental impact assessment of projects or prejudge the results of the corresponding environmental impact statements, since they are offered only to facilitate an early assessment from the first stages of defining a potential renewable energy project on the condition of a specific space with high environmental sensitivity.
