Deferred Development Areas (ZAD) on Rennes Métropole

Description

This layer of polygons lists the perimeters of the Zones d’Aménagement Différé (ZAD) on Rennes Métropole. ZADs are tools of land action at the service of public policy. A Zone d’Aménagement Différé (ZAD) is "a sector created by the state on the proposal of local authorities within which a pre-emption right applies allowing a community to acquire the real estate in the course of disposal as a matter of priority. Since its creation in 1962, the ZAD tool has been designed with a view to preparing long-term development operations, in order to prevent the announcement of a project from triggering an increase in land values. The right of pre-emption in ZAD must be exercised, like other pre-emption rights, “with a view to the realisation, in the public interest, of actions or operations corresponding to the objects defined in Article L.300-1, with the exception of those intended to safeguard or enhance natural areas, or to establish land reserves for the purpose of enabling the implementation of such actions or development operations” (Art. L.210-1 CU). It is a pre-emption tool, just like the urban pre-emption right (DPU). All disposals of immovable property for consideration in the area may be pre-empted, except for transactions excluded from the right of pre-emption by Article L.213-1 of the CU. The ZAD must meet the same purposes as the DPU. Although the right of urban pre-emption and the right of pre-emption in the ZADs comply with common rules, laid down in Articles L.213-1, R.213-1 et seq. of the Urban Planning Code, they nevertheless constitute two alternative procedures”.
