Scope of consideration (PPC) on Rennes Métropole
Description
This layer of polygons identifies the perimeters of consideration (PCC) on Rennes Métropole. The principle of a Consideration Perimeter (PPC) and a Statuer Survival Perimeter (PSS) is as follows: Consideration is given, within the meaning of Article L.424-1 of the Urban Planning Code, to a project of urban development or renewal, for example, in a sector of the territory and it is specified that a stay of proceedings may be applied to this sector on any application for a building authorisation which could compromise the operation (for a period of 10 years if this operation is not initiated by then). The concept of PPC and PSS is linked. This is in particular why in the automated urban planning information prepared by Rennes Métropole (in the AUCs), we display the following standard sentence when the case arises: ‘Field concerned by a perimeter of consideration (with possibility of suspension of stature)’. Where works, constructions or installations are likely to jeopardise or render more expensive the carrying out of a development operation within the scope of operations of national interest, the stay of proceedings may be set aside, under the conditions laid down in Article L. 424-1, where consideration of the development project has been taken into consideration by the competent administrative authority of the State and the land affected by that project has been delimited’. The decision to take into account shall cease to have effect if, within 10 years of its entry into force, the implementation of the development operation has not been initiated. The decision to take into account (PCC) is established by the developer of the project taken into consideration (deliberative assembly for local authorities, prefect for the State), by deliberation of the municipal council or of the legislative body of EPCI or by decision of the administrative authority (i.e. the developer of the project) which takes into account the development project already defined, or studies that are launched and which will make it possible to define it. This deliberation must delineate the land concerned. The plan accompanying the decision must be sufficiently precise to enable the parcels concerned to be identified (EC, 12 Nov. 2007, Minister for Equipment, No 281345). To be enforceable against an application for urban planning authorisation, the deliberation of “consideration” must have been published (posting in town hall for one month, publication in a newspaper and transmission in the prefecture) before the submission of this application.
