Description
Amount of PCR transactions and fines in euro since 2012.
The non-compliances in terms of restrictive commercial practice (PCR) identified by DGCCRF officials are diverse. They may be linked to the formality of the invoice (absence of an invoice or a mandatory mention on the invoice), regulated payment periods, non-compliance with the deadline for signing the single annual agreement between suppliers and distributors (= 1 March), commercial activity carried out illegally by an association (= paracommercialism), resale at a loss, at a minimum imposed price.
The establishment of a breach of PCR may lead to the drawing up of a report sent by the DGCCRF to the public prosecutor. If this PV is not closed without follow-up, the follow-up that can be given to it is either a transaction or a judgment (1st instance), and possibly a judgment in case of appeal of this judgment.
