INSPIRE - Municipal Development Scheme (SDC) in Wallonia (BE)

Description

This data layer compiles the constitutive spatial information of the Municipal Development Schemes (SDC) in Wallonia in INSPIRE-compliant format. The European Directive 2007/2/EC - INSPIRE Directive - establishes an infrastructure for spatial information in the European Community. INSPIRE applies to 34 thematic areas divided into 3 Annexes. This series includes the spatial data layers referring to land use (Annex 3.4). Within the meaning of the Directive, the theme "land use" covers "territories characterised by their intended functional dimension or their current and future socio-economic object (e.g. residential, industrial, commercial, agricultural, forestry, recreational)". The Code of Territorial Development (CoDT) entered into force on 1 June 2017 and modified the terminology and value of spatial planning tools in Wallonia. In its project planning approach, the CoDT puts in place the schemes, which are guidelines in which the spatial planning policy is carried out in Wallonia. There are four types of diagrams on different scales: one at regional level (SDT), one at multi-municipal level (SDPC) and two at communal level (SDC and SOL), Among these documents, the Communal Development Scheme (SDC - Art. D.II.9 et seq. of the CoDT) is one of the two communal schemes. It is drawn up on the initiative of the municipal council and approved by the Government. The SDC defines the territorial strategy for the entire municipal territory on the basis of a contextual analysis. The CoDT wanted to design this scheme as a tool which, on the one hand, ensures the sustainability of the former Municipal Structure Scheme (SSC) and, on the other hand, makes it possible to envisage a more forward-looking approach to the management of the municipal territory. The territorial strategy of the SDC defines the municipal territorial development objectives and the way in which these objectives delineate the regional objectives of the Territorial Development Scheme (SDT) or, as the case may be, the Pluricommunal Development Scheme(s) (SDP), the principles for implementing these objectives, and the territorial structure. The former Municipal Structure Scheme (SSC) defined in the CWATUP is assimilated to the SDC. Like the SSC, the SDC is indicative. It applies to the SOL, the Guide Communal d'Urbanisme (GCU) as well as to any decision taken on permits, certificates, declarations and land policy. A municipality may have only one SDC. At the map level, the data layer of the SDCs integrates the perimeters identified in the old SSCs within the meaning of the CWATUP.
