Description

The qualification of a watercourse is based on three cumulative criteria which must therefore be used to characterise a watercourse: 1 the presence and permanence of a bed, which was originally natural; 2 a sufficient flow rate for most of the year; 3 power from a source. The instruction of 3 June 2015 recalls that the methodology for identifying watercourses is based on the case law of 21 October 2011 of the Conseil d’État. Namely: “is a watercourse, a flow of running water into a natural bed originally fed by a source and having a sufficient flow of much of the year”. The list of rivers already determined by other regulations has been included in this identification, since they have previously been classified as having an interest in ecological continuity, as biological reservoirs, etc. The automatically integrated streams are as follows: — Lists 1 and 2 of L214-17 for ecological continuity — The biological reservoirs of the SDAGE — Bodies of watercourses — Rivers to be preserved primarily by the SAGE Ill Nappe Rhin — Full features named — Natura 2000 rivers As a result, river mapping will be updated according to its evolution in September of each year. It will represent new hydrographic areas validated with rivers and expert ditches. In addition, information will be provided on which flow it will be mandatory to set up a grassed strip (GAEC: Good agricultural and environmental conditions) of 5 metres.
