Description
The Act of 7 August 201 on the New Territorial Organisation of the Republic (NOTRe) is, after the law of modernisation of territorial public action and affirmation of metropolitan areas and the law on the delimitation of the regions, the third part of the territorial reform sought by the President of the Republic.
Its main purpose is to update the division of competences between the different strata of local authorities, in particular by removing the general competence clause of the regions and departments, and to strengthen the role of intercommunalities.
The latter objective is manifested in the municipalities’ obligation to be attached to an inter-communal structure with own taxation and in the desire to rationalise the map of these structures. The law thus provides for the revision of the departmental scheme for intercommunal cooperation (SCDI). The SDCI is a programming document, the requirements of which must comply with the eight guidelines laid down by law and codified in Article L5210-1-1 of the General Code of Local Authorities (CGCT).
