Description
Land riparian in a stream or stream bypass, or located in its watershed, or in an estuarine area, may be encumbered by a public utility easement having one or more of the following objects:
— creation of zones for temporary retention of flood or run-off water, by means of improvements to artificially increase their storage capacity for such waters, in order to reduce floods or runoffs in areas downstream;
— creation or restoration of areas for the mobility of the minor bed of a watercourse upstream of urbanised areas in areas known as ‘river mobility zones’, in order to preserve or restore its essential hydrological and geomorphological characteristics;
— preservation or restoration of wetlands known as “Strategic Water Management Areas” delimited by the Sustainable Management and Management Plan for Water Resources and Aquatic Environments of a Water Management and Management Plan (SAGE).
The generator of a public utility easement is a geographical entity whose nature or function induces, under the effect of regulation, constraints on the methods of land use of the surrounding land.
The disappearance or destruction on the ground of the generator does not result in the removal of the servitude(s) associated with it. Only a new act of annulment or repeal taken by the competent authority can legally remove the effects of the easement(s) in question.
