Types of Protection Programs

Description

The Species Decree provides for the possibility of drawing up a species protection programme (SBP). Such a programme is drawn up in consultation with the target groups and experts concerned by or on behalf of the Agency for Nature and Forests (ANB) and determined by the competent minister. It includes a number of measures aimed at ensuring that a species (or several species) is in a favourable state within Flanders. A species protection programme is established by the Minister and in principle has a duration of 5 years. Thereafter, on the basis of an evaluation, it may be continued, with or without the necessary adjustments or, if the species has made sufficient progress towards favourable status, transferred to other instruments. Measures included in an SBP are not legally enforceable against third parties, unless they concern additional specific prohibitions (only possible for species from category 3 of Annex 1, Species Decree) or derogations from the Species Decree. In that case, the SBP is adopted by the Flemish Government or its authorised representative, after consulting Minaraad and SALV (Strategic Advisory Council for Agriculture and Fisheries). However, in accordance with the Nature Decree, Article 16f, the management objectives and measures in a nature management plan must, where appropriate, be in accordance with species protection programmes. For example, an SBP provides substantive guidance to nature management plans. An SBP can be drawn up both for species to be protected at European level and for other species that are important for Flanders. On the basis of a number of criteria, a prioritisation is established for the species for which an SBP must be drawn up. This takes into account, among other things, the red list status and the surface needs of species, but also the need for ecological connections and whether other species can benefit from the protection measures. Species protection programmes have been drawn up for the species of the Port of Antwerp, the Beaver, the Smooth Snake, the Grey Harrier, the Grey Shrike, the Hamster, the Hazel Mouse, the Heivlinder, the Garlic Path, the Roerdomp, the Midwife Path, the Quail King and three fish species (i.e. Beekprik, River Thunder Path and Little Mud Creeper). The data itself consists of two separate geographical files: the SBPs for the fish and the SBPs for the other species. The difference between the files is that the first file consists of line-shaped elements, the second file consists of flat-shaped elements (polygons). The dates refer to the textual version of the approved respective SBPs and outline the project areas mentioned therein. These layers are only a tool, e.g. in the context of nature management plans, permitting or consultancy. For the interpretation of these layers, we refer to the respective SBPs. In the files offered, the project areas of the SBPs for the species of the Port of Antwerp, the Beaver and the Bats are not included. Currently, 4 SBPs are drawn up and adopted each year. The stocks are updated upon the adoption of new or the termination of ongoing SBPs. The dates were updated at the beginning of 2019: the approved dates of the SBP Porcelain Fowl, Brown Harrier and Tree Frog were added. A year later, the data was supplemented with the data from the SBP of Heikikker, Kamsalamander, Poelkikker and Rugstreeppad. In October 2021, the following species protection programmes were added: the Summer Tortel, the Flying Deer, the Great Mud Creeper and Meadow Birds with a focus on godwit and curlew. On 20 January 2023, the dates of the SBP of the Otter and of the renewed SBP of the Quail King were added. The data from the past SBPs (Grauwe harrier and Roerdomp) was removed from the data layer. In early September 2023, the SBP for Gladde slang and Heivlinder were extended until 31 December 2023.
