Fireworks, current medium and large fireworks (WFS Service)

Description

The data show the location (burning place) of all fireworks outdoors approved or displayed in the city of Dresden, divided by years. For the years 2010 and 2011, the exact name of the location as well as the number of fireworks carried out at a location in the respective year are recorded. From 2012, the date, time, type (exemption or display), category (2, 3 or 4) and the occasion of the fireworks will also be recorded. The following is an overview of the legal bases for the use of fireworks: Fireworks are fireworks according to § 6(6) of the 1. SprengV is divided into the following categories: Category 1: fireworks which present a very low risk, have a negligible sound level and are intended to be used in enclosed areas, including fireworks intended for use within residential buildings. Category 2: fireworks that present a low risk, a low have sound levels and are intended for use in confined areas outdoors. Category 3: Fireworks presenting a medium-sized hazard, intended for use in wide open areas outdoors, the sound level of which does not endanger human health. Category 4: fireworks presenting a major hazard which may only be used by persons with specialist knowledge (so-called "professional fireworks") and the sound level of which does not endanger human health. Category 1 fireworks (micro-fireworks) can be purchased throughout the year and may be used (burned) by persons over the age of 12. Category 2 fireworks (small fireworks) may be placed either on the 31st December and 1 January (New Year's Eve) or, with an exception, from the age of 18. Pursuant to Paragraph 24(1) of the First Ordinance on the Explosives Act (1. SprengV) exemptions from the ban on the purchase and use (burning) of fireworks of category 2 applicable outside the New Year's Eve period may be permitted "on justified grounds". According to the previous administrative practice, provided that a reasoned occasion (e.g. round birthday, school introduction, wedding, silver or golden wedding) is presented and provided that there are no compelling interests (e.g. nature conservation interests after the mandatory involvement of the nature conservation authority), these applications are granted, if necessary subject to conditions (e.g. with regard to the burning time). For the granting of such an exemption, an administrative fee of 75.00 Euro will be charged by our authority. In contrast to small fireworks, fireworks of category 3 and 4 (medium and large fireworks) may only be burned by licence and qualification holders in accordance with the Explosives Act (SprengG) due to their dangerous nature. Since it is thus ensured that only competent persons are allowed to burn these fireworks, the legislator has, in § 23(3) of the first SprengV for these larger fireworks throughout the year only one notification, but no authorisation requirement. Thus, these fireworks are to be notified to the competent authority only two weeks before burning, naming precisely designated information such as location, type and extent, start and end, safety and, in particular, shut-off measures and other protective measures. If there are no indications from this information that hazards could occur during the burning of the fireworks or that relevant regulations could be disregarded and that there are no overriding interests (e.g. nature conservation interests after the mandatory involvement of the nature conservation authority), there is no possibility of regulating or limiting these larger fireworks by the authorities. The burning of pyrotechnic objects in the immediate vicinity of churches, hospitals, children's and old people's homes as well as thatched and half-timbered houses is prohibited (Section 23(1) of the first Explosives). The competent authority may allow exceptions to this prohibition (Section 24(1)(1)). Explosives). Only tested and approved fireworks may be used. These are marked with an approval mark from the Federal Institute for Materials Research and Testing (BAM). Protection against noise pollution is regulated in § 3 of the Police Ordinance of the City of Dresden for the Maintenance of Public Safety and Order in Dresden (PolVO Sicherheit und Ordnung). Thereafter, it is forbidden to disturb the rest of others more than unavoidably from Sunday to Thursday from 10 p.m. to 6 a.m. of the next day, Friday and Saturday from midnight to 8 a.m. of the next day, and Saturday, Sunday and public holidays from 1 p.m. to 3 p.m. In conjunction with point 1.5 of Annex 1 to the General Administrative Regulation on the Explosives Act (SprengVwV), this results in the following burning times for fireworks in Dresden: Sunday to Thursday until 10 pm and Friday and Saturday until 10.30 pm (in May, June and July until 11 pm).
