Abandoned vehicles

Description

According to the No. 12/2015 Municipal Council Decision, the Department of Cleanliness and Environment of the Municipality of Metamorfosi checks compliance with the provisions concerning abandoned vehicles. Abandoned vehicles are identified either by the competent employees of the Abandoned Vehicle Registration and Marking Workshop of the Directorate for Cleaning and Recycling, or following a citizen’s complaint which can be made by telephone to the citizen’s four-digit telephone line, 1509. In order for a vehicle to be classified as abandoned, it must meet the following conditions referred to in Article 2(2) of Presidential Decree 116/04 (Government Gazette, Series I, No 81, 5.3.2004): να εγκαταλείπεται σε δημόσιους, δημοτικούς ή κοινοτικούς δρόμους στους οποίους απαγορεύεται η στάθμευση, για χρονικό διάστημα μεγαλύτερο από 30 ημέρες. να εγκαταλείπεται σε άλλους δημόσιους, δημοτικούς ή κοινοτικούς ή λιμενικούς κοινόχρηστους ή μη χώρους και οδούς για χρονικό διάστημα μεγαλύτερο από 90 ημέρες και χωρίς την άδεια της αρμόδιας Υπηρεσίας ή Αρχής. να εγκαταλείπεται σε ιδιωτικούς χώρους χωρίς προηγούμενη συγκατάθεση του κυρίου ή νομέα του χώρου κατά δήλωσή του. να αποτελεί γενικά κίνδυνο για το περιβάλλον, την υγεία και την ασφάλεια των κατοίκων, καθώς και για τη δημόσια ή ιδιωτική περιουσία, ιδίως όταν λόγω της καταστάσεως που βρίσκεται δεν δύναται να ανταποκριθεί στον σκοπό για τον οποίο προορίζεται. If one of the above conditions is met, the competent employees of the Registration and Marking Workshop shall affix a special sticker to the vehicle in a visible place, marking it as abandoned. The Metamorphosis Security Department is then duly informed and an audit is carried out, in accordance with Presidential Decree 116/04. If the abandoned vehicles bear registration plates, the owner is sought through the Archive of the Ministry of Transport and informed by letter of his removal. After 45 days from the affixing of the special sticker, if the vehicle is not withdrawn by its owner, it is in the possession of the Municipality and transferred to an approved ELV collection system ("end-of-life vehicle"). The vehicle shall remain at the collection point for 10 days from the day of collection. If within this time the vehicle is sought by its owner, then it is handed over to him. If the vehicle is not searched, then it is forwarded for further processing, recovery, shredding and disposal, as foreseen for ELVs. Also, according to the current Cleaning Regulation of the Municipality of Metamorfosi, a vehicle to which the special mark was affixed, because it was considered to be abandoned by law, is still treated as such even if its owner moves it a few meters, regardless of whether it bears registration plates or not. This is because the owner has the obligation to withdraw his vehicle to a private place within 45 days of affixing the mark, if he wishes to remain its owner and holder, otherwise the vehicle is in the possession of the Municipality. Therefore, the simple movement of the vehicle from the location found in another public place, within the administrative boundaries of the Municipality of Metamorfosi, does not interrupt or extend the deadline, while the procedure for the collection of the abandoned vehicle is followed without interruption, as defined by the relevant provisions. The procedure is the same for vehicles that do not have registration plates, while the owner is additionally charged with the penalties provided for if he does not comply with the content of the solemn declaration of Law 1599/1986 that he signed with the deposit of the plates of his vehicle, that he will keep it in a private place.
