Risk areas outside floodplains (Section 78b of the Water Resources Act)
Description
These are areas for which a significant flood risk has been identified in accordance with Section 78b of the Water Resources Act and which, in the event of a flood with a low probability [HQextrem], can be flooded beyond the specified or provisionally secured flood area. The status of the basics used can be found in the attribute table. The situation and legal liability result from the information for risk areas of the HQextrem from the 2. Cycle (2019) of the Flood Risk Management Directive (HWRM Directive) as well as the current information for defined flood zones and provisional safeguards.§ 78b WHG Risk zones outside flood zones (version in accordance with amendment by Flood Protection Act II)(1) Risk zones outside flood zones are areas for which hazard maps must be drawn up in accordance with § 74(2) and which are not defined as flood zones in accordance with § 76(2) or (3) or are provisionally secured; this does not apply to areas that are predominantly influenced by the tides, unless otherwise specified by state law. In the case of risk areas outside floodplains, the following applies:1. in the designation of new construction areas in the outdoor area and in the preparation, amendment or supplementation of urban development plans for areas to be assessed pursuant to Section 30(1) and (2) or Section 34 of the Building Code, the protection of life and health and the prevention of significant damage to property must be taken into account in the assessment pursuant to Section 1(7) of the Building Code; this shall apply mutatis mutandis to statutes pursuant to Section 34(4) and Section 35(6) of the Building Code;2. outside the areas covered by No 1, structural installations shall only be constructed or substantially extended in accordance with generally accepted technical rules in a construction method adapted to the respective flood risk, insofar as such a construction method is technically possible in accordance with the nature and function of the installation; the construction requirements should also take due account of the location of the land concerned and the level of potential damage.(2) Further legislation of the Länder remains unaffected.These data are also available in the INSPIRE data model ‘Annex 3: Areas with Natural Risks’.
