Special right of pre-emption § 25 BauGB
Description
The Building Code (BauGB) offers the municipality the opportunity to establish a special right of pre-emption by (in Hamburg) regulation.
The adoption of such an ordinance is at the discretion of the city if it is necessary to ensure the preparation and implementation of urban development measures. It is to be regarded as an instrument of preventive land acquisition; It is not intended to facilitate the general acquisition of land by the city.
The Preemption Ordinance is intended to ensure the management of a separate urban development by Hamburg during the term of e.g. preparatory studies of an urban development measure.
