Water book Hamburg

Description

Water books must be kept for the waters. In accordance with § 87 of the Water Resources Act (WHG) in conjunction with § 98 et seq. of the Hamburg Water Act (HWaG), the following in particular must be entered in the respective water book: - Permits and authorisations - old rights and powers - Water protection areas - Floodplains and risk areas - Decisions on maintenance, expansion and flood protection In the water books, the rights of use of above-ground waters and groundwater, which go beyond general use and are transferred by the competent water authorities through administrative acts, are entered. The entries include the type of use (e.g. groundwater extraction, construction of a jetty) as well as information on the extent of use (e.g. permitted flow rates, size of the jetty). The database is not up-to-date on a daily basis. The purpose of the Water Book is to provide public bodies acting on or responsible for the protection of water bodies, as well as citizens, with a comprehensive overview of the main legal relationships in water bodies. Anyone is therefore permitted to inspect the water book, its copies and the documents referred to in the entry. In accordance with the order on responsibilities in the field of water law and water management, there are two departments in Hamburg that keep the water book separately for their area of responsibility and register very specific legal relationships there. The water books of these services have the following contents: * Water Book of the Environment, Climate, Energy and Agriculture Authority (BUKEA/W2) The Department of Wastewater Management (W2) of BUKEA maintains the Water Book for permits pursuant to § 10 WHG for the discharge of wastewater into water bodies or for the abstraction of water from water bodies for the following waters: Outer and inner Alster with the Elbe-sided Fleet, Elbe as well as all harbour waters, Este, Dove-Elbe below the Tatenberg lock, Lower Bille and its canals, Harburg inland port, department store canal, eastern station canal, western station canal and ship ditch. The master data of all permits are completely recorded in a database; since about the end of 1999, the complete water booklet contents of new entries and changes are kept in parallel in this database. The water book contains data on: - groundwater (exception: Neuwerk), - Waters II. Order (exception: Neuwerk) and - Waters I. Order (exceptions: Neuwerk/ Elbe/ Harbour waters/ Permits for discharge or removal in accordance with § 8 WHG), - regulations on the maintenance and development of surface waters, and - Regulations and decisions on the construction and modification of state flood protection systems and the approval of pipelines in dikes and dams. * Water book of the Hamburg Port Authority (HPA) The water book of the HPA/213 - includes, among other things, water permits for the use and expansion of the waters of the Elbe, port waters, Este, Old South Elbe, floodplains of the Elbe and foothills of the Old South Elbe as well as permits under dyke law for the private flood protection facilities (polders) and uses on Neuwerk.
