Description
In the health districts of Merano, Bressanone and Brunico, the activities of forensic medicine relate to hygiene and public health services, which are therefore divided into two sections:
hygiene and public health;
forensic medicine.
In the Health District of Bolzano the functions of forensic medicine are carried out by an autonomous service with competence throughout the province.
The activities of forensic medicine, regulated by the l.p. 13.01.1992, n.1, consist mainly of: checks to verify temporary incapacity for service; collegial assessments for general and specific suitability for work or permanent disability; assessment of the medical and legal requirements necessary for the recognition of the right to supplementary health benefits for users of the Provincial Health Service; health care for disabled civilians, war victims, persons in service, the blind and deaf and dumb, and other protected categories; forensic examinations for the purpose of issuing the "invalid stop" sign; medical-legal checks also for the purpose of compensation and insurance, aimed at verifying any professional responsibilities by health personnel; opinions and technical judgments on the various and often complex problems of the medico-legal doctrine in the health field; collegial assessments for the recognition of civil disability and disability.
The Legal Medicine Service of Bolzano also deals with the assessment of the fitness to drive motor vehicles of the disabled (Local Medical Commission), the collegial assessments for the recognition of blindness and deafness, the extraordinary reviews of civil disability and the placement of the disabled at work (commission l. 68/99), as well as the suitability for the release of the firearms (commission appeals). The Legal Medicine service, following the application of the Inter-compartmental Collective Agreement of 13 August 1999, is also responsible for employees of the public administrations of the Province, in terms of suitability for employment, exemption from service, recognition of infirmity due to service. It then carries out, at the request of the judicial authority, judicial police tasks.
Some forensic services are also carried out by the staff of the public health and hygiene services and by the district hygienists of the Province, in particular health checks for the port of arms and visits for driving licenses of vehicles and boats.
At the offices of the Department of Health, citizens of South Tyrol have the opportunity to file an appeal against a series of decisions taken by the health districts of the South Tyrolean Health Authority or by the provincial offices themselves. Users can avail themselves of the Provincial Appeals Commission for the following aspects: non-reimbursement of costs of hospital assistance or indirect specialist assistance, non-granting of prosthetic aid, non-acceptance of the application for civil disability, assessment of the seriousness of a disabled person and granting of the related benefits referred to in Law 104/92, and also in the case of granting the parking card for disabled people, cycles of rehabilitative care, exemption from the requirement of seat belts, psycho-physical fitness for work, service license.
