List of marriages, separations, divorces and cancellations year 2015 on a monthly basis
Description
The dataset contains the number of civil and religious marriages, as well as the number of separations, divorces and annulments (Legislative Decree No 132/2014) that took place in the municipality of Lecce in 2015 on a monthly basis.
Decree-Law No 132/2014, which entered into force on 13 September 2015, introduced two new instruments that completely revolutionise the procedure, with the aim of simplifying and managing in a shorter time the process to end the marriage between two people or modify the conditions (of separation and divorce) already set previously by the judge.
The first instrument is offered by Article 6(1) of the Decree, which provides that the spouses may apply to a lawyer to conclude an ‘assisted negotiation agreement’ in order to reach a consensual solution of legal separation, termination of the civil effects of the marriage, dissolution of the marriage (in the cases referred to in Article 3(1)(2)(b) of Law No 898/1970) and modification of the conditions of separation and divorce.For those who, on the other hand, wish to opt for a DIY procedure, Article 12 allows the spouses to go directly to the civil status officer of the municipality of residence (of both, of one of the two or of the municipality with which the marriage is registered or transcribed), to say goodbye without the help of a lawyer, concluding ‘a legal separation agreement, or, in the cases referred to in Article 3(1)(2)(b) of Law No 898 of 10 December 1970, dissolution or termination of the civil effects of the marriage, modification of the conditions of separation or divorce’.
Also in this case the operation is very simple: the officer receives the declarations of each of the parties, according to the conditions agreed between them, then the agreement is drawn up and signed immediately which will produce the same effects as the judicial measures
