Social Conservation Ordinance according to §172 Abs.1 Satz 1 Nr. 2 BauGB Conversion Ordinance according to §172 (1) sentence 4 BauGB The map shows areas of an existing or in preparation Social Conservation Ordinance in Hamburg. The state of play of the areas (in the establishment procedure, in force) is marked. In areas with a legally binding Social Conservation Ordinance, the Conversion Ordinance automatically applies. Currently, social conservation regulations have been issued for the following areas: - Southern Neustadt, St. Pauli, St. Georg, Northern Neustadt (district of Hamburg-Mitte), - Altona-Altstadt, Altona-Nord, Ottensen, Bahrenfeld-Süd, the Schanzenviertel and the Osterkirchenviertel ( Altona district), - Eimsbüttel-Süd and Eimsbüttel / Hoheluft-West / Stellingen-Süd (district of Eimsbüttel), - Eilbek (Wallsbek district). The list includes social conservation ordinances for Borgfelde (district of Hamburg-Mitte) as well as Barmbek-Nord, Barmbek-Süd and Jarrestadt (district of Hamburg-Nord). The aim of the Social Conservation Ordinance pursuant to Section 172(1)(1)(2) of the Building Code (BauGB) is to preserve the composition of the resident population for special urban planning reasons. The displacement of the resident population is to be prevented in order to avoid adverse urban development effects. As prerequisites for this, the concrete social structure of the resident population as well as the urban planning effects of the feared displacement must be evaluated. The protective effect of a social conservation regulation is that certain measures within the area of a social conservation regulation must additionally be examined whether they endanger the composition of the resident population in the area. These measures include the demolition of buildings and parts of buildings, construction measures and modernisations, which can increase the residential value and lead to rent increases, as well as the change in the use of rented apartments in commercial spaces. In the areas covered by the Social Conservation Ordinance, the Conversion Ordinance pursuant to the fourth sentence of Paragraph 172(1) of the BauGB also applies. With the aim of counteracting a presumed displacement of residents in the course of the conversion of a rental apartment into a condominium, conversions of rental apartments into condominiums in these districts are therefore subject to approval. The right of pre-emption pursuant to point 4 of the first sentence of Paragraph 24(1) of the BauGB may also be exercised by the city if a land acquisition takes place in an area with a social conservation ordinance in which the assumption of a speculative intention is justified. Unless the original purchaser of the land contractually undertakes to fulfil the objectives and purposes of the Social Conservation Ordinance.
