Conditions of use of near-surface geothermal energy for geothermal collectors (up to 5 m depth) in Lower Saxony 1 : 500 000

Description

The map "Terms of use of near-surface geothermal energy - geothermal heat collectors" shows a classification in three area categories for the use of geothermal heat by geothermal heat collectors • no reasons for restricting the use of geothermal energy at the LBEG are known, • Reasons for restricting the use of geothermal energy at the LBEG are known, • Inadmissible use of geothermal energy. This classification was drawn up in accordance with the approval procedure for the construction and operation of geothermal heat collectors described in the guideline "Erdwärmenutzung in Niedersachsen". It expressly does not contain any information on the technical development possibilities of geothermal energy. The map is based on the information available for the state of Lower Saxony on all topics summarised in the legend and applies to geothermal collectors that, by definition, intervene in the subsoil to a depth of 5 m. The competent Lower Water Authority shall check, on the basis of the required notification or application and the site conditions, whether the conditions for the construction and operation of a geothermal collector system are met in the areas where the LBEG is aware of grounds for restriction and in the areas where the LBEG is not aware of grounds for restriction. - In areas where the LBEG is not aware of any restrictions, the Lower Water Authority checks whether it has further information for the location that is not listed in the LBEG map. If there are no grounds for restricting the geothermal energy project, the planned project can be processed in the notification procedure. The requirements for construction and operation for the use of geothermal energy (Annex 1b) described in the guideline ‘Using geothermal energy in Lower Saxony’ must be observed. If the planned site is affected by restrictions, the notification will be considered as an application for a water permit, provided that the applicant has stated this in his application. In the permit procedure, the Lower Water Authority determines in the context of a case-by-case assessment under water law whether and under which conditions geothermal heat can be used. The Lower Water Authority assesses which requirements that go beyond the general requirements of the Guide must be granted within the framework of a permit pursuant to §§ 8, 9 WHG. In this case, the applicant receives a permit under water law with ancillary provisions. - In areas where restrictions are known to the LBEG (see Guide ‘Gedwärmenutzung in Niedersachsen’, Location factors Chapter 6), the Lower Water Authority first checks whether the stated restrictions are relevant to the planned geothermal project or not applicable on site, e.g. because the reason for restriction occurs at a greater depth and the planned geothermal plant does not reach this depth. If these restrictions do not affect the planned site, the Lower Water Authority will check whether there is further information on the site that is not listed in the LBEG map. If there are no grounds for restricting the geothermal energy project, the planned project can be processed in the notification procedure. The requirements for construction and operation for the use of geothermal energy (Annex 1b) described in the guideline ‘Using geothermal energy in Lower Saxony’ must be observed. If a safe assignment of a location on the basis of the map is not possible or there are other local indications of conditions that affect the use of near-surface geothermal energy, the Lower Water Authority or, if applicable, the LBEG will provide assistance on request. The data are used for an initial assessment of the conditions of use for geothermal collectors and do not replace the concrete check in the context of plant construction on the basis of the local conditions.
