Compensation measure under nature conservation law
Description
The property type includes all areas of the Department of Compensation Measures under Nature Conservation Law recorded in the Baden-Württemberg Compensation Register, which are part of the intervention regulation.
In general, the intervention regulation is differentiated between the intervention regulation under nature conservation law and the intervention regulation under building planning law, which in turn are divided into compensation and eco-account measures. The interference regulation is an instrument of nature conservation law, which, with its general prohibition of deterioration, is intended to ensure a minimum protection of nature and landscape even outside protected areas. By means of a binding decision sequence in the approval of interventions, it is intended to counteract adverse effects on nature and landscape and to compensate for unavoidable adverse effects.
The intervention regulation under nature conservation law (§§ 13 - 18 of the Federal Nature Conservation Act (BNatSchG)) applies to outdoor areas, to construction projects under construction law in outdoor areas in accordance with § 35 of the Building Code (BauGB) and to development plans that replace a planning approval. The legal obligation to maintain the compensation list results from the Federal Nature Conservation Act (BNatSchG § 17 (6): procedures; Authorisation to issue statutory ordinances) in conjunction with the Baden-Württemberg Nature Conservation Act (NatSchG § 18: Compensation Register) and the Compensation Register Ordinance (KompVzVO § 1: Contents of the compensation directory).
