88. monitoring the resolution of denationalization procedures before administrative bodies - the situation as at 30. 9. 2024

Description

Based on previous reporting (situation at 30. 6. 2024), the number of cases finally closed in administrative units increased by 2, from 38 415 to 38 417 cases. However, the total number of pending cases in administrative units decreased by 7 during this three-month period and now stands at 33. By the 88th monitoring of the completion of the denationalisation process, 34 administrative units had completed the procedures in their entirety, including all final cases. At the first instance of decision-making, all cases have five administrative units closed, namely Mozirje, Piran, Radlje ob Dravi, Ruše and Tržič), but some cases are still under appeal. The Ministry of Culture, which decides at first instance on the denationalisation of objects protected under the regulations on the protection of cultural heritage, has 15 pending cases at first instance and 7 cases in appeal, while the Ministry of Natural Resources and Spatial Planning, which decides at first instance on the return of property protected under the regulations on nature conservation, has 1 pending case and 2 cases in appeal at first instance. A total of 39 715 denationalisation claims were lodged with all administrative bodies at the first instance of decision-making (administrative units, MK, MKGP, MOP and MF), of which 39 635 cases were finally closed, representing 99.8% of the total number of cases lodged. 80 cases remain open, of which 49 are pending at first instance and 31 cases in appeal at second instance and in the Administrative and Supreme Court. In a period of three months, the ministries dealing with complaints in the second instance resolved a total of 8 denationalisation cases. In the second instance (i.e. in the appeal to ministries), a total of 12 denationalisation cases are still pending.
