86. monitoring the completion of the denationalization process - the situation as at 31. 3. 2024

Description

Based on previous reporting (situation at 31.12.2013) 12. 2023), the number of cases finally closed in administrative units increased by 2, from 38,410 to 38,412 (out of 38,472 cases). However, the total number of pending cases in administrative units decreased by 3 over this three-month period (from 46 pending cases to 43 pending cases). By the 86th monitoring of the completion of the denationalisation process, 33 administrative units had completed the procedures in their entirety, including all final cases. At the first instance of decision-making, all cases are closed by five administrative units, namely Cerknica, Mozirje, Radlje ob Dravi, Ruše and Šmarje pri Jelšah, which still have some cases in appeal. The Ministry of Culture, which decides at first instance on the denationalisation of objects protected under the regulations on the protection of cultural heritage, has 16 pending cases at first instance and 8 cases in appeal, while the Ministry of Natural Resources and Spatial Planning, which decides at first instance on the return of property protected under the regulations on nature conservation, has 1 pending case and 4 cases in appeal at first instance. A total of 39 715 denationalisation claims were lodged with all administrative bodies at the first instance of decision-making (administrative units, MK, MKGP, MOP and MF), of which 39 626 cases were finally closed, representing 99.77% of the total number of cases lodged. 89 cases remain open, of which 60 are pending at first instance and 29 cases in appeal at second instance and in the Administrative and Supreme Court. In a period of three months, the ministries dealing with complaints in the second instance resolved a total of 8 denationalisation cases. In the second instance, a total of 10 denationalisation cases remain unresolved.
