85. Follow-up of the completion of the denationalisation process by the administrative authorities – situation as at 31.12. 2023

Description

According to previous reporting (situation as at 30). 9. 2023) the number of final cases in administrative units increased by 4, from 38.406 to 38.410. However, the total number of pending cases in administrative units decreased by 1 over this three-month period. By the 85th follow-up of the completion of the denationalisation process, 32 administrative units had completed the procedures in full, with all final cases closed. At the first stage of the decision-making process, all cases have closed five administrative units, namely Cerknica, Domžale, Mozirje, Radlje ob Dravi and Ruše, which have some cases in the appeal. The Ministry of Culture, which decides at first instance on the denationalisation of property protected under the regulations on the protection of cultural heritage, has 14 pending cases at first instance and 10 appeal cases, while the Ministry of Natural Resources and Spatial Planning, which decides at first instance on the return of property protected under nature conservation regulations, has 2 pending cases at first instance and 3 appeal cases. A total of 39.715 denationalisation claims were submitted to all administrative bodies at the first stage of decision-making (administrative units, MKGP, MOP and MF), of which 39.624 cases were finally closed, representing 99.77 % in relation to all cases brought. There are still 91 pending cases, of which 62 pending cases at first instance, and 29 in the second instance appeal, as well as in the Administrative and Supreme Court. The second-instance ministries resolved 8 denationalisation cases over a period of three months. In the second instance, a total of 7 denationalisation cases are still pending.
