83. monitoring the completion of the denationalization process - the situation on the 30th 6. 2023

Description

Based on previous reporting (situation at 31.12.2013) 3. 2022), the number of cases finally closed in administrative units increased by 3, from 38,401 to 38,404. However, the total number of pending cases in administrative units increased by 1 during this three-month period. By the 83rd monitoring of the completion of the denationalisation process, 32 administrative units had completed the procedures in their entirety, including all final cases. At the first instance of decision-making, all cases have three administrative units closed, namely Cerknica, Domžale and Ruše, which still have some cases in appeal. The Ministry of Culture, which decides at first instance on the denationalisation of objects protected under the regulations on the protection of cultural heritage, has 10 pending cases at first instance and 14 cases in appeal, while the Ministry of the Environment and Spatial Planning, which decides at first instance on the return of property protected under the regulations on nature conservation, has 2 pending cases and 3 cases in appeal at first instance. A total of 39 715 denationalisation claims were lodged with all administrative bodies at the first instance of decision-making (administrative units, MK, MKGP, MOP and MF), of which 39 618 cases were finally closed, representing 99.75% of the total number of cases lodged. 97 cases remain open, of which 59 are pending at first instance and 38 cases in appeal at second instance and in the Administrative and Supreme Court. In a period of three months, nine denationalisation cases were solved in total by the ministries dealing with complaints in the second instance. In the second instance, a total of 12 denationalisation cases are still pending.
