Development plan Bergedorf 42 1st change Hamburg
Description
The following provisions are added to Section 2 of the Ordinance on the Bergedorf development plan 42 of 21 April 1970 (Hamburgisches Gesetz- und Verordungsblatt, page 159):
‘3. In the core area between Sachsentor Street and Bergedorfer Schloßstraße from the western border of parcel 572 to the eastern border of parcel 543 (new: 4535) of the Gemarkung Bergedorf are not permitted arcades and similar undertakings within the meaning of Section 33i of the Gewerbeordnung, which are used for the installation of play equipment, with or without opportunities for profit, as well as sales premises, demonstration and commercial premises, the purpose of which is aimed at the sale of articles, representations or acts of a sexual nature.
4. The core area referred to in point 3, to which the Ordinance for the Protection of the Saxonytor Milieu Area of 13 June 1978 (Hamburg Law and Ordinance Gazette, page 202) applies, is defined as the ‘maintenance area’ under § 172 of the Building Code. In this area, in order to preserve the specific urban design of the area, due to its urban design, demolition, modification, alteration of use or construction of buildings are subject to authorisation, even if no authorisation is required under the Building Exemption Ordinance of 5 January 1988 (Hamburgisches Gesetz- und Ordinance Gazette, page 1). Permission for demolition, modification or change of use may only be refused if the building site alone or in connection with other structural installations shapes the locality or city shape or is otherwise of urban planning, in particular building history. Authorisation for the construction of the building may be refused only if the urban design of the area is affected by the construction requested.’
