Development plan Bergedorf 42 1st amendment Hamburg

Description

The following provisions are added to § 2 of the Bergedorf 42 Development Plan Ordinance of 21 April 1970 (Hamburg Law and Regulation Gazette, page 159): "3. In the core area between the road Sachsentor and the Bergedorfer Schloßstraße from the western boundary of the parcel 572 to the eastern boundary of the parcel 543 (new: 4535) of the district of Bergedorf, amusement arcades and similar undertakings within the meaning of § 33i of the Gewerbeordnung, which serve to install gaming equipment with or without profit opportunities, as well as sales rooms and sales areas, demonstration and business premises, the purpose of which is aimed at the sale of articles, representations or acts of a sexual nature, are inadmissible. 4. The core area referred to in point 3, for which the Ordinance for the Protection of the Environment Area Sachsentor of 13 June 1978 (Hamburg Law and Ordinance Gazette page 202) applies, is defined as a "conservation area" pursuant to Section 172 of the Building Code. In this area, in order to preserve the urban character of the area due to its urban design, demolition, modification, change of use or construction of structures require a permit, even if a permit is not required under the Building Exemption Ordinance of 5 January 1988 (Hamburgisches Gesetz- und Verordnungsblatt page 1). Permission to demolish, modify or change the use may only be refused if the construction alone or in connection with other constructions characterizes the townscape or the cityscape or is otherwise of urban planning, in particular architectural history significance. Authorisation to construct the structure may be refused only if the urban design of the area is affected by the proposed structure."
