Description
Update of areas polluted with nitrates – backdrop from 15.01.2022
According to § 2 of the NDüngGewNPVO of 3 May 2021, the area delimitation of areas contaminated with nitrates and eutrophicated areas is based on the field blocks as of 1 February 2021.
If the pruning of field blocks changes after 1 February 2021, the newly cut field blocks shall form part of the site backdrop if their area is predominantly located in the designated areas. In accordance with the Provincial Regulation, the updated status will be effectively presented on the LEA portal as of 15 January 2022.
For the preparation of the updated nitrate backdrop valid as of 15 January 2022, the currently most up-to-date field block geometries as of 1 October 2021 will be blended with the previous nitrate backdrop. A new field block geometry is therefore affected by the provisions of the LandesVO if the area of the new field block is predominantly - i.e. more than 50% - in the background in accordance with the NDüngGewNPVO of 3 May 2021.
As no technical reassessment of the emission risk for the field blocks can be carried out as of 1 October 2021, the previous basic maps for the identification of the emission risk in accordance with AVV GeA §§ 7-9 remain unchanged. This dataset can therefore only be used to determine whether a field block as at 1 October 2021 is part of the backdrop updated on 15 January 2022 in accordance with Section 2(2) of the NDüngGewNPVO.
