Annual statistics of the Commercial Court of Lyon for the year 2021
Description
These data consist of a statistical insight into the activity of the **Tribunal de commerce de Lyon** for the year 2021, concerning both the work in connection with the Trade and Companies Register and the judicial role of the Lyon Commercial Court.
The statistics were unveiled at the annual solemn hearing on Tuesday, January 25, 2022.
As far as the commercial and companies register is concerned, no less than 24,741 new **company registrations** were registered, with 11,305 creations of **commercial companies** and 3,994 civil companies. At the same time, the graft carried out 8,929 radiations. The total number of registrations, amendments, additional registrations and cancellations amounted to 73,583.
As regards litigation, 2021 represented the second year of the introduction of the obligation to constitute (lawyer before the Tribunal de commerce de Lyon) (https://www.taillanter-avocat-lyon.com/avocat-commercial-lyon-droit) in excess of EUR 10 000 in litigation.
This significant change has not had the effect of reducing the number of **judgments rendered on the merits by the Lyon Tribunal**, with a total of 1 758 judgments rendered in 2021 with or without pre-trial proceedings. Interim orders even increased compared to 2020, from 999 orders issued to a total of 1,045.
The same applies to the number of new cases: There are a total of 1818 incoming cases in 2021, compared to 1531 in 2020.
As a sign of the development of alternative dispute resolution, no less than 439 conciliation openings under the **general commercial litigation** took place in 2021, with an encouraging rate of dispute resolution of 46.70%.
With regard to the **orders for payment** issued by the **President of the Tribunal de commerce de Lyon**, there are a total of 2 814 decisions issued, with a total of 184 oppositions, a sign of the increasing effectiveness of this mechanism for the rapid recovery of contractual claims.
Finally, for the **collective proceedings**, there are a total of 766 opening judgments, including 626 rulings on the opening of bankruptcy proceedings. It should be noted that 575 cases originate from a declaration of cessation of payments filed by debtors, against only 12 referrals at the request of the Public Prosecutor's Office.
