Description
Easements of public utility (SUP) affecting land use are instituted according to the rules specific to each of the separate legislations of the Urban Planning Code. These administrative limitations on the right to property may be imposed for the benefit of public persons (State, local authorities, public establishments), service or public works concessionaires (GRT Gaz), private persons engaged in an activity of general interest. Where SUPs resulting from specific legislation directly affect land use or constructibility, they are included in a list drawn up by decree in the Council of State and annexed to Article R 126-1 of the Urban Planning Code. They are divided into four main categories: Servitudes relating to the conservation of heritage. Easements relating to the use of certain resources and equipment. Servitudes relating to National Defence. Easements relating to health and public safety. The data are not enforceable, only the paper format approved by the Community Council is enforceable against third parties.
