Mandatory prior administrative appeals (RAPO) in the context of the post-parking package at the City of Antibes
Description
In the context of the M.A.P.T.A.M Law of 27 January 2014 on the decriminalisation and decentralisation of paid parking, the City of Antibes laid down the rules applicable to paid parking on public roads and parks located on its territory.
The implementation of this reform has introduced, depending on the specificities of the sectors concerned, a parking fee, payable:
- either by immediate payment to the time stamp, depending on the duration chosen by the user,
- or by deferred payment, in the event of non-payment or insufficient payment, in connection with the issue of a Post Parking Package (PFS), calculated on a flat-rate basis and equal to the rate payable by the user for the maximum duration of parking.
In the latter case, the user-debtor has a maximum period of three months, after receipt of the payment notice, to pay it. At the same time, the latter may also challenge that lump sum, in the context of a compulsory preliminary administrative appeal procedure (R.A.P.O).
This dataset specifies the details of the R.A.P.O. processed since the establishment of the F.P.S. under the conditions laid down in Article R 2333-120-15 of the General Code of Territorial Collectivities.
It shall contain, in particular, the number of appeals lodged, the grounds for challenge, the meaning of the decisions taken, the grounds for inadmissibility, rejection or annulment, and the average processing time.
