State schemes in favour of employees of firms in difficulty
Description
The Court takes stock of the schemes in favour of employees of undertakings in difficulty financed by the State and the social partners. The report covers a period prior to the Covid-19 outbreak, but its findings and recommendations may be useful for public debate, pending the Court’s return to it in the coming months. When a company encounters difficulties, the employer must take all adaptation and reclassification measures to keep employees in employment. The State contributes to this support and uses several intervention mechanisms, ranging from the detection of firms in difficulty to aid the reclassification of employees who have lost their jobs. These tools, in particular partial activity, can be mobilised with a reinforcement of exceptional resources in the face of a major deterioration in the economic situation. Their cost increased by 3.3 between 2008 and 2010, from around EUR 760 million to almost EUR 2.55 billion; from 2016, it decreased to around EUR 1.5 billion in 2019. 90 % of this expenditure has so far been related to reclassification measures, including the professional security contract put in place in 2011.
