Definition: A Public Land Establishment (EPF) is a public industrial and commercial establishment (EPIC) that negotiates and conducts procedures for building land reserves upstream of the implementation phase of a public development project. The EPF has the competence of “land recycling”, i.e. land control, purchase, porting, management, rehabilitation of land (and therefore its possible remediation), as well as the management of all studies useful for this land control. The public land establishment is a legal person with financial autonomy. There are two types of public land establishment (EPF): • state EPF • local EPFs In the Burgundy-Franche-Comté region, as of 18 December 2019, there are only 3 local EPFs: • EPFL de Côte d’Or • EPFL du Doubs BFC • EPFL interdepartmental Foncier Coeur de France The Établissements Publics Fonciers Locaux (EPFL) were established with the Loi d’orientation pour la ville (LOV) of 13 July 1991. The Urban Solidarity and Renewal Act (SRU) then gave EPFL a new legal framework by relaxing their way of constitution and financing. The creation of an EPFL is the result of the deliberations of the EPCI and the municipal councils of municipalities not members of EPCI, which determine the list of members of the establishment, the operating arrangements, the duration, the seat and the composition of the general meeting or of the board of directors. It is the local and regional authorities who direct the activity of the institution once it has been set up, via the board of directors composed of representatives of the member authorities.
