Recognition of the state of natural disasters in Antibes
Description
Compensation for natural disasters is provided for by Law No 82-600 of 13 July 1982, the provisions of which are set out in the Insurance Code (Articles L. 125-1 et seq. of the Insurance Code). That scheme provides for compensation for ‘non-insurable direct material damage caused by the abnormal intensity of a natural agent’. The compensation provided for in the texts requires:
— that the property affected is guaranteed by a contract of damage (water damage, fire, etc.);
— that the commune be recognised in a state of natural disaster by an inter-ministerial decree issued by the State and published in the Official Journal.
