Description
The right of urban pre-emption offers the possibility for a public person, within a predefined scope, to substitute himself for the possible purchaser of a property put up for sale or which is the subject of a donation (except those made between persons of the same family) and to acquire it as a priority, in order to carry out a development operation or to set up land reserves for a development operation.
The DPU may be instituted by deliberation:
• In municipalities with a land use plan (POS) or a local urban planning plan (PLU) on all or part of the urban areas (U) and future urbanisation (AU) delimited by those plans (zones U and NA for POS).
• And on all or part of their territories covered by a Safeguarding and Enhancement Plan (PSMV).

**Collection method**
The perimeter of the Right of Urban Preemption is materialised by polygons, based on the zonings of the Local Plans of Urbanism and Municipal Maps, and based on the deliberations that instituted the DPUs.
