Indirect access right (TAJ, STIC, JUDEX)

Description

For police files, such as the Processing of Judicial History (TAJ), people have, since Decree no. 2018-687 of 1 August 2018, a right of access and direct rectification: they must send their request to the Ministry of the Interior and no longer to the CNIL. It is now only if, at the end of a period of two months, this ministry opposes them a restriction or does not respond to them, that they have the right to refer the matter to the CNIL for the indirect exercise of their rights. **This indirect access right (DAI)** allows the verification of these files by certain members of the CNIL (magistrats). The applicant shall be informed of the action taken on these checks. The dataset contains the number of requests received by the CNIL from 2012 to 2018 concerning the national police and gendarmerie files **STIC** (Constated Offence Processing System) and **JUDEX** (judicial documentation and exploitation system) of the national police and gendarmerie, then the file **TAJ** (Treatment of Judiciary antecedents) which succeeded them on 1 January 2014, as well as the results of the checks carried out during the same years. ** Warning 1**: the re-user’s attention is drawn to the fact that, on the one hand, the number of requests received in the year must be distinguished and, on the other hand, the number of checks carried out in the same year which incorporates, taking into account the processing times relating to those files, requests made in previous years. ** Warning 2**: for any question about the operation of the TAJ file and the help that the CNIL can give you, **please do not use the “Discussions” below**, which are visible to all and reserved for exchanges on published data sets; **use the Need for help service (https://www.cnil.fr/fr/cnil-direct) or contact the CNIL on 01 53 73 22 22**.
