List of approaches covered by the principle “Silence is worth agreement”
Description
The [Law of 12 November 2013 empowering the Government to simplify relations between the administration and citizens] (http://www.legifrance.gouv.fr/eli/loi/2013/11/12/2013-1005/jo/texte) lays down the principle that the silence kept by the administration on a request is an agreement. These provisions shall apply from 12 November 2014 to applications addressed to the administrations of the State and its public institutions from that date. [However, this principle is subject to exceptions provided for by law or by decrees](http://legifrance.gouv.fr/Droit-francais/Silence-vaut-accord-SVA).
The list of actions concerned is included in this dataset, which lists the procedures for which the silence kept by the administration at the end of a fixed period constitutes acceptance of the request.
These provisions have been applicable since 12 November 2014 to applications addressed to the administrations of the State and its public institutions.
They shall apply from 12 November 2015 to applications addressed to local and regional authorities, social security bodies and bodies entrusted with an administrative public service.
The list of procedures concerned is set out in a table dedicated to each administrative authority (see [http://legifrance.gouv.fr/Droit-francais/Silence-vaut-accord-SVA](http://legifrance.gouv.fr/Droit-francais/Silence-vaut-accord-SVA)):
— Table of procedures for which the silence kept by the State services on a request constitutes agreement
— Table of procedures for which the silence of local and regional authorities on an application constitutes agreement
— Table of procedures for which the silence kept by social security bodies on an application constitutes agreement
— Table of procedures for which the silence kept by the other bodies entrusted with an administrative public service on an application constitutes agreement
These lists do not in themselves have any legal value. They are published for public information purposes. They identify procedures which do not fall within any of the exceptions provided for by law or by decrees which provide, under the conditions laid down by law, for derogations from the principle of “silence is an agreement”.
