**Number of persons accused of violating aliens legislation

Since Law No. 2012-1560 of 31 December 2012, index 69 covers only offences of irregular entry into the national territory.
This change in the scope of the index 69, induced by the law, has resulted in no longer being able to rely on traditional statistical tools (including index 69).
Thus, the sharp decline recorded in 2012 is a direct consequence of the case-law of the Court of Cassation of 5 July 2012, drawing the consequences of the interpretation by the Court of Justice of the European Union of Directive 2008/115/EC of the European Parliament and of the Council of Europe of 16 December 2008, known as the Return Directive. The Court of Cassation rejected the application of the police custody procedure solely on the ground of the irregularity of the stay of a foreign national. This resulted in a period of procedural uncertainty, marked by large differences in treatment at the local level, which led to an overall slowdown in arrests on the grounds of mere irregular stay.
By establishing a new legal framework for the treatment of irregular residence, Law No. 2012-1560 of 31 December 2012 allowed a revival of the activity of services in this field, which, although moderate in the very first months of 2013, has steadily increased.
