Exercise of indirect rights (general data)

Description

For some **sensitive files** (information files, FICOBA, etc.), the law does not allow direct consultation. Any person can then ask the CNIL to verify, on their behalf, whether information about them is recorded in these files. For police files, such as the Treatment of Judicial History (TAJ), persons have, on the basis of Decree No 2018-687 of 1 August 2018, a right of direct access and rectification: they must send their request to the Ministry of the Interior and no longer to the CNIL. It is now only if, at the end of a period of two months, that ministry imposes a restriction on them or does not reply to them, that they have the option of bringing an action before the CNIL for the indirect exercise of their rights. This **exercise of indirect rights** or "EDI" (formerly **right of indirect access** or "DAI") allows the verification of these files by certain members of the CNIL (magistrates). The applicant shall be informed of the follow-up given to those checks.
