The first data item contains the Declarations of Public Utility (DUP), « the expropriation procedure allows a local authority to appropriate private immovable property by authority, in order to carry out a public utility development project. The second data item provides information on the Programmed Operations for Habitat Improvement (OPAH), « Concerted action between the State, the National Agency for the Improvement of Housing (ANAH) and one or more municipalities whose objective is to rehabilitate the built heritage and improve the comfort of housing. One of the means of setting up this type of operation is to grant increased rates of subsidy to landlords and owner-occupiers, under certain conditions. Action of an incentive nature, it aims to create favorable conditions for the realization of habitat improvement works in the perimeters concerned. Incentive scheme implemented with the partnerships of the National Agency for the Improvement of Housing (ANAH) and local authorities (here City of Montpellier and Montpelier agglomeration) whose objective is to rehabilitate the built heritage (housing and condominiums). Within the targeted perimeters, grants to landlords and owner-occupiers, under certain conditions, on themes defined as priorities, in order to combat unworthy housing.
The third data item provides information on the pre-emptions of goodwill, namely the scope of the introduction of the right of pre-emption on goodwill, craft funds and commercial leases. Regulated by the Urban Planning Code, the right of urban pre-emption allows a local authority to take the place of the purchaser when selling property, knowing that only immovable property is covered, movable property and rights, such as business assets or commercial leases, being excluded. Established by deliberation of the Municipal Council of Montpellier n°2010/262, the right of pre-emption of business assets, craft funds or commercial leases aims to preserve the attractiveness and specific attractiveness of structuring commercial poles in the city centre, to improve operating conditions and the maintenance of particular professional activities, to limit the impact of excessive specialisation processes of certain commercial sites and linear sites and to be able to counter any speculative approach and any overbidding resulting from the implementation of structuring commercial urban projects.
