Segments of the Public Domain Fluvial (DPF) - Metropolis

Description

An Element of the River Public Domain is either a part of a Water Course, a Water Plan, or a Works belonging to the river public domain. The river public domain is the result of a historical process that has evolved over time: - the Ordinance of 1835 establishing the "Nomenclature of Inland Waterways", - the watercourses referred to in subsequent acts of incorporation, including international treaties, - classified since 2003 by order of classification of the prefect coordinator of basin or of the territorial collectivity, - in the French overseas departments, all watercourses Water Police Services / MISE identified by the 2005 circular. These regulatory texts constitute, according to the Element of the Public Domain Fluvial, the founding regulatory text of it. An element of the Public Domain Fluvial belongs to the State with the exception of those which have been transferred to a community or group of communities by order of the PCB (including in the DOM) and the watercourses incorporated directly into the DPF by the competent authority of a community. Originally the DPF was created for navigation purposes. Some elements have been removed from the "Waterway Nomenclature" and retained in the CFO without special assignment. Since 1964, it has been possible to assign elements to the CFO for purposes other than navigation. The same historical reasoning applies to decommissioning texts and makes it possible to identify the competent authority responsible for the decommissioning. Decommissioning implies the return of the segment to ordinary law. The transverse limit of the sea serves as the downstream limit of the River Public Domain. The Segment of the Public Domain Fluvial allows the link to the national hydrographic repository by allowing its division for the needs of the DPF theme.
