Perimeter reserved for waters (ERP)
Description
The water perimeter (ERP) corresponds to the water area as defined in the Federal Water Protection Act (LEaux) and its implementing Ordinance (OEaux). It includes the riparian area of watercourses and bodies of water which is subject to various legal requirements relating to the possibilities of construction and the operation of these areas. The perimeter layer reserved for water includes the elements below. PRE: — — no installation may be constructed other than those whose location is imposed by their intended purpose and which serve public interests. In specific cases, certain facilities may be authorised by the authorities after weighing interest. — Existing installations, legally constructed, benefit from the guarantee of the acquired situation. Their necessary maintenance is permitted. The question of the eligibility of a replacement, renewal, major expansion or reassignment will require a weighing of interests in the course of which it will also be necessary to consider whether the facility should be moved out of the RSP. — The use of fertilisers or plant protection products is prohibited. Plant-by-plant treatments are allowed, for plants with problems beyond a 3 m band, if it is impossible to combat them in any other way. Extensive farming is possible only in the form of litter area, hedge, field grove, wooded bank, riverside meadow, extensive grassland, extensive grazing or wooded grazing. The requirements of this paragraph shall also apply to the operation of areas outside the useful agricultural area (e.g. vegetable gardens, lawns, green spaces). Densely built areas: — — In a densely built area, the EAR may be adapted to the boundaries of the existing building if flood protection is guaranteed (Article 41a (4) (a Waters)). The concept of a densely built area is not legally defined and is specific to the theme of the EAR. It is also possible to authorise construction in the EAR in a densely built area, provided that there is no overriding interest in it.
