Environmental inspections in accordance with the Industrial Emissions Directive

Description

Directive 2010/75/EU on industrial emissions (integrated pollution prevention and control) of 24 November 2010 entered into force on 6 January 2011, replacing the previous Directive 2008/1/EC and five other Directives. It was transposed into German law on 2 May 2013 and at the same time the Federal Immission Control Act, the Circular Economy Act and the Water Resources Act as well as their sub-statutory regulations were amended. As particularly environmentally relevant within the meaning of the European directive on industrial emissions, which was approved in Germany, inter alia, by Annex 1 to the 4th Ordinance on the Implementation of the Federal Immission Control Act (4. BImSchV), those annexes which are marked with an "E" there apply. The environmental monitoring includes the on-site inspection by the competent authority, for installations under mountain supervision it is the State Office for Mining, Energy and Geology. The content of the on-site inspection is based on the monitoring plan1 in accordance with Article 23 of Directive 2010/75/EU of the European Parliament and of the Council and Section 52a of the BImSchG. The monitoring plan shall include the following elements: den räumlichen Geltungsbereich des Plans, eine allgemeine Bewertung der wichtigsten Umweltprobleme im Geltungsbereich des Plans, ein Verzeichnis der in den Geltungsbereich des Plans fallenden Anlagen, Verfahren für die Aufstellung von Programmen für die regelmäßige Überwachung, Verfahren für die Überwachung aus besonderem Anlass sowie -soweit erforderlich - Bestimmungen für die Zusammenarbeit zwischen verschiedenen Überwachungsbehörden. The inspection interval shall be based on a systematic assessment of the environmental risks associated with the installation and the interval between two on-site inspections shall not exceed one year for installations subject to the highest risk level and three years for installations subject to the lowest risk level. The assessment shall take into account the potential and actual effects of the installation on human health and the environment, as well as the sensitivity of the local environment, the risk of accidents arising from the installation and compliance with permit requirements. Within four months of the environmental inspection, the summary sheet shall be actively made available to the public. If serious deficiencies are identified, operators have six months to rectify them and a new on-site inspection is carried out by the supervisory authority. Landfill sites within the meaning of Directive 2011/97/EU of 05.12.2011 (OJ 2011 L 328, p. 49) (Landfill Directive) also fall under its regulatory scope in accordance with point 5.4 of Annex I to the IED. The monitoring plan2 for landfills pursuant to Article 23(4) of Directive 2010/75/EU of the European Parliament and of the Council and Paragraph 47(7) of the KrWG and Paragraph 22a of the DepV contains requirements to be applied in the authorisation and monitoring of landfills. The monitoring plan for landfills shall include the following elements: den räumlichen und zeitlichen Geltungsbereich des Plans, den inhaltlichen Geltungsbereich des Plans eine Bewertung der Umweltsituation im Geltungsbereich des Plans, ein Verzeichnis der in den Geltungsbereich des Plans fallenden Deponien, Kriterien für die Festlegung der Überwachungsintervalle der Regelüberwachung der Deponien, Verfahren für die Überwachung aus besonderem Anlass sowie die Durchführung der Vor-Ort-Besichtigung bei Deponien gemäß IE-Richtlinie. The inspection interval is based on a systematic assessment of the environmental risks associated with the landfill. The interval between two on-site visits shall not exceed one year for Class III landfills, two years for Class II landfills and three years for Class I landfills, both during the deposition and decommissioning phases. By way of derogation, all publicly accessible landfills of Classes I and II shall be monitored at least once a year. Within four months of the environmental inspection, the summary sheet shall be actively made available to the public. If serious deficiencies are identified, operators have six months to rectify them and a new on-site inspection is carried out by the supervisory authority.
